These Terms of Service ("Terms") govern your use of the Presfit website and your participation in services offered by Samuel Cooper d/b/a Presfit ("Presfit," "we," "us," or "our"). By using our website, booking a session, or becoming a member, you agree to these Terms.

1. Our Services

Presfit provides semi-private fitness coaching, nutrition and habit coaching, mindset coaching, program delivery through the Presfit app, community events, and a complimentary Transformation Session (strategy and assessment session). Services are delivered inside FXB in Waxahachie, Texas.

2. Health and Medical Disclaimer

Consult your physician before starting any exercise or nutrition program. Presfit coaches are fitness professionals, not medical doctors, and our services are not medical advice, diagnosis, or treatment.

You confirm that you are physically able to participate and that you will tell your coach about any injuries, medical conditions, medications, or limitations before training. Stop exercising and seek medical attention if you feel pain, dizziness, or shortness of breath. Individual results vary, and testimonials on our site reflect the experiences of specific members, not a guarantee of your results.

3. Assumption of Risk and Waiver

Physical training carries inherent risk of injury. Certain optional events, such as archery, martial arts or bladed-tool training, and shooting range days, carry additional risks. You voluntarily assume these risks. Members must sign Presfit's separate Liability Waiver and any event-specific waivers before participating. To the fullest extent permitted by law, you release Presfit, its owners, coaches, and staff from claims arising from your participation, except where caused by our gross negligence or willful misconduct.

4. Scheduling and Attendance

Semi-private groups are capped at 6 people and are first come, first served. Please arrive on time and let us know as soon as possible if you can't make a session or your Transformation Session, so the spot can go to someone else. Missed sessions are not credited or refunded.

5. Code of Conduct

We expect respectful behavior toward coaches, members, and FXB staff, and compliance with all FXB facility rules. We may suspend or end the membership of anyone who behaves unsafely, disrespectfully, or in violation of these Terms, without refund of prepaid amounts.

6. Text Messaging (SMS) Terms

By providing your mobile number and opting in, you agree to receive text messages from Presfit about your inquiry, appointments, membership, and offers. Consent is not a condition of purchase.

Carriers are not liable for delayed or undelivered messages.

7. Photos, Video, and Testimonials

We may photograph or record sessions and events for marketing. We will ask for your permission before featuring you by name or face, and you may decline at any time by telling your coach.

8. Website Use and Content

All content on this website, including text, logos, images, video, and training programs in the Presfit app, belongs to Presfit or its licensors. You may not copy, resell, or distribute it without our written permission. You agree not to misuse the site or interfere with its operation.

9. Limitation of Liability

To the fullest extent permitted by law, Presfit is not liable for indirect, incidental, or consequential damages arising from your use of our website or services. Our total liability for any claim will not exceed the amount you paid Presfit in the 3 months before the claim arose.

10. Governing Law

These Terms are governed by the laws of the State of Texas. Any dispute will be resolved in the state or federal courts located in Ellis County, Texas.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows when they were last revised. Continued use of our website or services means you accept the updated Terms.
